This Privacy Policy explains how Happy Shift LLC ("HappyShift," "we," "our," or "us") collects, uses, and protects personal information when you use our workforce scheduling platform and related services (the "Service"). HappyShift is a Wyoming limited liability company.
Who we serve
HappyShift provides scheduling software to licensed home care agencies in the United States. Our users fall into two groups:
- Agency coordinators — staff at home care agencies who use the HappyShift dashboard to manage shifts and caregivers
- Caregivers — W-2 employees or 1099 contractors of those agencies who receive SMS or voice notifications about open shifts
HappyShift does not provide services directly to patients, clients, or the general public, and we do not collect or store protected health information (PHI).
Information we collect
Information agencies provide
- Agency name, address, contact information, and billing details
- Coordinator names, email addresses, and login credentials
- Caregiver rosters, including caregiver names, mobile phone numbers, certifications, availability, and scheduling notes
- Client (patient) first names, shift locations, and required caregiver certifications, used solely for scheduling purposes. We do not collect patient last names, medical records, or any clinical information.
Information caregivers provide
- Shift responses (accept/decline) sent via SMS or voice
- Double opt-in confirmation responses (reply "Y") when first enrolled by an agency
- Opt-out requests (reply "STOP") at any time
Information collected automatically
- Device and browser information, IP address, and usage analytics when you visit our website
- Message delivery receipts and call metadata from our SMS and voice providers
How we use information
- To deliver shift notifications via SMS and voice to eligible caregivers on behalf of their employer agency
- To operate, maintain, and improve the HappyShift platform
- To respond to support requests and communicate with agencies and caregivers about the Service
- To comply with legal obligations and enforce our terms of service
Mobile information and SMS messaging
We do not share mobile opt-in data or consent with third parties for marketing purposes. Phone numbers collected for SMS shift notifications are used solely to deliver shift-related messages on behalf of the caregiver's employer agency and are never sold, rented, or shared with third parties for advertising or promotional use.
When a caregiver is enrolled in HappyShift by their employer agency and confirms consent via double opt-in, we collect and store:
- The caregiver's mobile phone number (provided by the employer agency)
- The date and time the agency attested to collecting consent
- The date and time the caregiver replied "Y" to confirm the double opt-in
- Any subsequent opt-out requests

Caregivers can opt out of SMS messages at any time by replying STOP to any message. We honor all opt-out requests immediately.
How we share information
We share personal information only in the following limited circumstances:
- With the caregiver's employer agency — agencies see caregiver information and shift responses for their own roster
- With service providers — vendors who help us operate the Service (e.g., SMS and voice providers, cloud hosting, database services), subject to confidentiality obligations and limited to what is necessary to provide their service
- When legally required — if required by law, subpoena, or valid legal process
- In a business transfer — if HappyShift is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction
We do not sell personal information. We do not share mobile opt-in data or phone numbers with third parties for marketing or promotional purposes.
Data security
We implement reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit, access controls, and regular security reviews. No method of transmission over the Internet is 100% secure, so we cannot guarantee absolute security.
Data retention
We retain personal information for as long as needed to provide the Service, comply with legal obligations, and enforce our agreements. When a caregiver opts out of SMS messages, we retain the opt-out record indefinitely to ensure we continue to honor the opt-out. When an agency stops using HappyShift, we delete or anonymize agency and caregiver data within a reasonable period unless legally required to retain it.
Your rights
Depending on your location, you may have the right to:
- Access the personal information we hold about you
- Correct inaccurate information
- Request deletion of your information
- Opt out of SMS messages at any time (reply STOP)
- Withdraw consent for SMS messaging at any time

Children's privacy
HappyShift is not directed to children under 16 and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can delete it.
Changes to this policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Effective" date at the top of this page and, where appropriate, notify users through the Service or by email.
